1. Agreement & Acceptance
These terms govern the hire of any equipment, trailer, portable toilet, mobile fridge, mobile fridge or septic-pumping service supplied by Fumuno Toilet & Trailer Hire (“Fumuno”, “we”, “us”). Placing a booking or paying a deposit constitutes acceptance of these terms in full.
2. Bookings, Quotes & Deposits
Written quotes are valid for 14 days from date of issue. A booking is confirmed only on receipt of the required deposit (typically 50%) and a signed rental agreement. Balance is payable before or on delivery unless otherwise agreed in writing.
3. Delivery, Setup & Collection
Delivery windows are estimates. The client must ensure safe, level and legal vehicle access to the drop-off location. Fumuno is not liable for delays caused by inaccessible sites, incorrect addresses or on-site conditions. Additional charges apply for aborted deliveries or standing time.
4. Client Responsibility & Care
The client is responsible for the hired equipment from delivery until collection, including protecting it from theft, vandalism, misuse and abnormal wear. The client must provide a suitable, secure site and, where applicable, a stable power supply (220V) and water connection.
5. Damage, Loss & Insurance
The client is liable for any loss, theft or damage beyond fair wear and tear. Repair or replacement costs will be invoiced at market rates. We recommend the client arrange short-term insurance cover for high-value hires or long-distance events.
6. Cancellations & Refunds
Cancellations more than 7 days before delivery are refunded less a 10% administration fee. Cancellations 3–7 days before delivery forfeit 50% of the deposit. Cancellations within 72 hours forfeit the full deposit. Weather-related event postponements are handled case-by-case in good faith.
7. Servicing & Waste Disposal
Portable toilet servicing is performed on the frequency stated in the rental agreement. All waste is disposed of at licensed municipal treatment facilities. Additional servicing outside the agreed schedule is charged as a call-out.
8. Limitation of Liability
To the maximum extent permitted by South African law, Fumuno’s total liability arising from any hire is limited to the value of the specific rental. We are not liable for indirect, consequential or event-cancellation losses.
9. POPIA & Privacy
We collect only the personal information required to quote, deliver and invoice your booking. Data is stored securely, is not sold or shared with third parties, and can be deleted on written request in line with the Protection of Personal Information Act (POPIA).
10. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any dispute will be resolved in the courts of Gauteng.
